As of February 2, 2026, the answer to that is “No.” The VA has not changed ratings for sleep apnea. If they find that your sleep apnea is service connected, and you need treatment with a CPAP or other breathing assistive device, that still likely warrants a 50% rating.

Are the ratings for sleep apnea changing soon?

The answer to that, unfortunately, is “We don’t know.”

The VA proposed changes on February 15, 2022, and we’ll include a link to that proposal below, but there’s been no official decision on what the final changes will be or when they’ll come into effect.

If you suffer from sleep apnea, and it started during your service or was caused by weight gain that is connected to your service, it’s probably a good idea to get your application in sooner rather than later and keep up on your appeals. That way, your condition will be rated under the law as it now stands, and you won’t need to worry about the proposed changes.

If you’ve been denied for sleep apnea, we’d be glad to give you a call to talk about how we could help with appealing your claims. You can click on this link and leave your number, and one of our team will reach out.
